December 15, 2010: ICC Has Approved the Results of the Long-Term RFP

On Wednesday, December 15, 2010, the Illinois Commerce Commission ("ICC") approved the results of the Long-Term RFP for ComEd's portfolio.

In accordance with the Act and ICC Orders, the Procurement Administrator is releasing the information concerning the results of the RFP as posted to the Long-Term Renewable Energy and RECs Documents page: 2010 Long-Term RFP Results.



December 9, 2010: REMINDER: Long-Term RFP Bids are Due Today

The Bid Date in the Long Term RFP is today. You must submit your bids between 10 AM and 12 PM (noon) (Central Prevailing Time) today.

December 2, 2010: Supplier Fees

The Supplier Fee for the 2010 ComEd Long-Term RFP is:

$3.50 per MWh of the annual contract quantity won in the RFP.

The Supplier Fees are paid only by suppliers whose bids are approved by the Illinois Commerce Commission.



November 15, 2010: FINAL REMINDER: ComEd Long-Term RFP DEADLINE Time Provided to Cure Deficiencies for Part 1 Proposals

The deadline for the Submission of Part 1 Proposals is 12PM (noon) CPT Tomorrow, Tuesday, November 16, 2010. All Bidders – including Bidders that submitted materials in the September Long-Term RFP must submit materials for their Projects to be considered in this re-issued RFP.

The Procurement Administrator performs an initial review of all Part 1 Proposals. If the Part 1 Proposal arrives before 12 PM (noon), the Procurement Administrator performs the initial review on the day the Part 1 Proposal is received; if the Part 1 Proposal is received after 12 PM noon, the Procurement Administrator performs the initial review by the morning on the next business day. If the Part 1 Proposal for your Project is incomplete or requires clarification, the Procurement Administrator will send a deficiency notice to you and you will have additional time to cure any deficiency or provide additional information.

November 3, 2010: Invitation to Comment on the Interim Draft of the Master Agreement

The Illinois Power Agency ("IPA") proposes the procurement of 1,400,000 MWh of renewable energy and associated Renewable Energy Credits ("RECs") in each year of a 20-year contract. Delivery under the contract would begin on June 1, 2012. NERA Economic Consulting has been retained by the Illinois Power Agency ("IPA") as the Procurement Administrator for the portfolio of Commonwealth Edison Company ("ComEd").

On October 13, 2010, the Procurement Administrator invited comments on the Long-Term Master Agreement dated September 7, 2010. The Long-Term Master Agreement is based on the standard contract form of the ISDA Master Agreement with certain modifications and specific terms. All Suppliers to ComEd under the terms of the Long-Term Renewable Energy and RECs RFP would sign this Long-Term Master Agreement. On October 28, 2010, the Procurement Administrator released draft amendments on the basis of the comments received. Interested parties had an opportunity to comment on this Interim Draft.

Today, November 3, 2010, the Procurement Administrator is releasing the Final Draft. The Final Draft includes clearly marked draft amendments on the basis of written comments received as well as discussion at the October 26 and November 1 Workshops.

Interested parties are invited to comment on the Final Draft. Interested parties may provide written comments to the Procurement Administrator exclusively according to the process detailed below. Interested parties are also invited to participate in the November 4, 2010 Workshop that will be dedicated to the review and discussion of the Final Draft.

The process to submit written comments on the Interim Draft is as follows:
  • Only comments relating directly to the proposed amendments will be considered.
  • A submitter must either: (i) submit comments electronically in Microsoft Word with tracked changes and add an explanatory note as needed. Each explanatory note should reference the amendment label (e.g., "Change 2.1"); or: (ii) provide comments in electronic format where each comment references the specific amendment label to which it pertains.
  • Submitters provide their comments by email to the Procurement Administrator at the following e-mail address: pa@comed-energyrfp.com.
  • Submitters provide telephone and email contact information in case clarification is needed.

October 25, 2010: POSTING - Comments to the Long-Term Master Agreement

The Procurement Administrator received comments on the Long-Term Master Agreement from fourteen (14) parties. These comments are posted to the Long-Term RFP Documents page. The comments are organized by the document to which the comments pertain. The name of the file identifies the party submitting the comments (labeled Submitter 1, Submitter 2, … etc). The general comments of parties (those that did not pertain to a specific Long-Term Master Agreement document) are posted under the heading "Long-Term Master Agreement – General Comments".

Further, the Procurement Monitor has offered comments to provide context and history for the contract changes to be proposed in the upcoming workshops. These are posted separately to the Long-Term RFP Documents page.

The Illinois Power Agency ("IPA") proposes the procurement of 1,400,000 MWh of renewable energy and associated Renewable Energy Credits ("RECs") in each year of a 20-year contract. Delivery under the contract would begin on June 1, 2012. NERA Economic Consulting has been retained by the Illinois Power Agency ("IPA") as the Procurement Administrator for the portfolio of Commonwealth Edison Company ("ComEd").

The Procurement Administrator is proposing as the standard contract form the ISDA Master Agreement with certain modifications and specific terms. The current draft of the contract (the "Long-Term Master Agreement") is dated September 7, 2010 and is posted to the RFP Web site (http://www.comed-energyrfp.com/ltdocuments.asp).

Interested parties are invited to submit their comments on the Long-Term Master Agreement. All Suppliers to ComEd under the terms of the Long-Term Renewable Energy and RECs RFP would sign this Long-Term Master Agreement. All comments received in accordance with the process outlined below will be reviewed and the Long-Term Master Agreement will be revised based on the comments received from interested parties as well as comments from representatives of ComEd, the Procurement Administrator, Staff of the ICC, the Procurement Monitor, and the IPA.

Written comments submitted to the Procurement Administrator will be posted to the RFP Web site and made publicly available. The Procurement Administrator will redact the name of the party submitting the comments but will not attempt to redact any information that may otherwise identify the submitting party.

The timeline and process for interested parties to provide comments on the Long-Term Master Agreement are as follows:
  • The exclusive method for submitting comments is electronically in Microsoft Word with tracked changes. Interested parties are strongly encouraged to provide an accompanying document with explanatory notes or to add an explanation beside each tracked change.
  • Comments must be submitted by email to the Procurement Administrator at the following e-mail address: pa@ComEd-EnergyRFP.com. Please provide telephone and email contact information in case clarification is needed.
  • The deadline for comments is Friday, October 22, 2010 at 6PM CPT.


Workshops will be held in Chicago to further discuss the Long-Term Master Agreement. The first workshop will take place on October 26, 2010 to review written comments received on the contract and to compile a list of issues raised. Draft amendments will be circulated for review at a second workshop that will take place on Monday, November 1, 2010. A final draft of the contract will be issued for discussion at a third workshop that will take place on Thursday, November 4, 2010. Details of the schedule for these workshops will be released as soon as practicable.

October 13, 2010: Long-Term RFP Resumes Under NEW Schedule - Upcoming Workshops in Chicago

The schedule for the Long-Term RFP has been revised to provide an opportunity for interested parties to submit a second round of written comments on the contract proposed by the Procurement Administrator. This contract, entitled "Long-Term Master Agreement" and dated September 7, 2010, is available here. Written comments submitted to the Procurement Administrator will be posted to the RFP Web site and made publicly available. The Procurement Administrator will redact the name of the party submitting the comments but will not attempt to redact any information that may otherwise identify the submitting party. The deadline for interested parties to provide comments is Friday, October 22, 2010 at 6PM CPT. The Procurement Administrator will issue a detailed invitation to comment that will be posted to the RFP Web site as soon as practicable.

The Illinois Power Agency ("IPA") and the Procurement Administrators for the ComEd Long-Term RFP and for the Ameren Long-Term RFP are scheduling three workshops. The first workshop will take place on October 26, 2010 to review written comments received on the contract and to compile a list of issues raised. Draft amendments will be circulated for review at a second workshop that will take place on Monday, November 1, 2010. A final draft of the contract will be issued for discussion at a third workshop that will take place on Thursday, November 4, 2010.

September 25, 2010: IMPORTANT: Proposed Schedule Revision to the IPA’s ComEd/Ameren Illinois Utilities Long-Term Renewable Energy and REC RFP

A revised schedule has been proposed for the IPA's Long-Term Renewable Energy and REC RFPs for the Commonwealth Edison and Ameren Illinois Utilities.

The purpose of the schedule revision is to provide the public with additional opportunities to provide input on certain contract terms and conditions and to afford bidders more time to prepare bid packages.

Please note that while we are seeking additional comments and potential changes to the terms and conditions of the power purchase agreements, many contract terms are dictated by the Illinois Commerce Commission Order and are NOT subject to change. We recommend that all potential bidders review the current ICC Order for case 09-0373 with regard to these terms and focus their comments during the planned Bidder Workshops on issues outside of these settled items.

September 10, 2010: ANNOUNCEMENT - Evaluation Parameters – Solar Target and Budget

This announcement confirms the parameters that will be used in the evaluation of Bids for the ComEd Long-Term RFP.

The evaluation and selection of Bids for the Long-Term RFP in no case will result in the procurement of an aggregate quantity that exceeds the Target of 1,400,000 MWh annually or that combine to cost more than the Budget of $22,868,155.

The evaluation of Bids and the selection of renewable energy resources first give priority to cost effectiveness, second to resource type, and last to location. For renewable energy resources of a given price and a given location, renewable energy resources from wind resources and solar photovoltaic resources are selected over other renewable energy resources eligible under the Act, subject to a 75% threshold for wind and to a threshold of 6% for solar photovoltaic.

Additional details regarding the evaluation are provided in Appendix 5 of the RFP Rules.

The Standard Pre-Bid Letter of Credit has been posted to the RFP Web site.

A Bidder may, in its Part 1 Proposal, request modifications to the Standard Pre-Bid Letter of Credit. A Bidder requests modifications to the Standard Pre-Bid Letter of Credit by submitting a Draft Pre-Bid Letter of Credit indicating clearly all modifications in Microsoft Word with tracked changes. The Draft Pre-Bid Letter of Credit may be saved to a CD that is included with the Part 1 Proposal or the Draft Pre-Bid Letter of Credit may be e-mailed to the Procurement Administrator at pa@comed-energyrfp.com. Any modification approved for one Bidder is available to all Bidders on an optional basis.

A Bidder, in its Part 2 Proposal, must provide an executed Pre-Bid Letter of Credit, drawn for the account of the Bidder. April 13, 2010: REMINDER: Comments on the REC Contract Form are due TODAY

The Illinois Power Agency ("IPA") will solicit offers for Renewable Energy Credits through a Request for Proposals ("Renewables RFP" or "REC RFP") for the ComEd portfolio. The Procurement Administrator (NERA Economic Consulting, Inc) is proposing as the standard contract form the ABA-EMA-ACORE Master Renewable Energy Certificate Purchase & Sale Agreement with certain modifications and specific terms (the "REC Master Agreement"). The draft of the REC Master Agreement was posted to the Web site (www.ComEd-EnergyRFP.com) on April 6, 2010.

The Procurement Administrator invites interested parties to submit their comments on the REC Master Agreement. All comments received will be reviewed by representatives from the IPA, the Procurement Administrator, the Procurement Monitor, Staff of the Illinois Commerce Commission ("ICC"), and ComEd.

April 5, 2010: POSTING: Supplement to the Part 1 Form (Standard Products RFP)

The Supplement to the Part 1 Form ("Supplement") for the Standard Products RFP is now available on the Standard Products Documents page.

The Supplement is required with the Part 1 Proposal. The Supplement is used to prepare the Master Agreement (and Guaranty, if applicable) that must be executed and presented with the Part 2 Proposal.

The Procurement Administrator responds to a question by email directly to the questioner and then the question and answer are posted to the Web site as an FAQ. FAQs will be posted daily.



March 24, 2010: Comparison of 2010 Draft Contracts to 2009 Contracts

The Illinois Power Agency ("IPA") will issue an RFP to solicit offers for standard energy products to meet the supply needs of eligible retail customers of Commonwealth Edison Company ("ComEd"). It is expected that all successful suppliers - both current and new suppliers - will be required to sign a standard contract with ComEd.
