FAQ-62Upon completion of the bidding process in the Standard Products RFP, what information will be made public and when?

Pursuant to section 16-111.5(h) of the Illinois Public Utilities Act (220 ILCS 5/16-111.5(h)), available here on the Illinois General Assembly Web site, the names of the successful bidders and the load-weighted average of the winning bid prices for each contract type will be made public at the time of approval of the results by the Illinois Commerce Commission.

FAQ-61When will winning RFP Bidders in the Standard Products RFP be notified that they are among the winning combination of suppliers?

A detailed timeline, including the post-bid process, will be fully specified in the Standard Products RFP Rules, to be posted by February 8, 2008.

The latest that winning RFP Bidders could be notified that they are among the winning package of bids would be the day of the decision by the Illinois Commerce Commission on the results. However, it is expected that winning RFP Bidders could be notified earlier if they are part of the winning package being presented to the Commission, with the understanding that the Commission still has to render a decision on the results of the bids.

FAQ-60This is concerning the Standard Products RFP. Will ComEd execute the Master Agreements of losing bidders? What will ComEd then do with the executed contracts of losing bidders?

ComEd will not execute the signature pages of the Master Agreements of losing bidders. ComEd will return all copies of the signature pages of the Master Agreement to losing bidders on the day the Commission rules on the results of the procurement event.

FAQ-58We assume from the announcement dated January 18, 2008, available here, that there will be a different contract form and other items for the 2008 ComEd Renewable Energy Credits Procurement. Is this correct?

Yes, there will be a different contract form for the procurement related to renewable energy products, which will be posted to the Renewables page in the early part of February.

FAQ-56Has a date been picked for when bids will be due on the 2008 ComEd Standard Products RFP?

FAQ-55In the Standard Procurement EEI Master Agreement (available here), can you clarify whether the intent is on having are Collateral Thresholds applicable? In the Cover Sheet elections, "Not Applicable" is selected for Collateral Thresholds, yet you include a ratings matrix for Collateral Thresholds in the Collateral Annex Paragraph 10 (available here). However, Collateral Thresholds are not elected either the EEI Master Agreement Cover Sheet, or the Collateral Annex. Could you please clarify?

The intent is that there is a Collateral Threshold that is applicable to both parties and that the Collateral Threshold for each party is defined by reference to either Section I.A or Section I.B of paragraph 10 to the Collateral Annex as specified on the Cover Sheet. Tables therein provide for a determination of each Party's Collateral Threshold based on its credit rating and tangible net worth.

The box 'Collateral Threshold' was checked as not applicable in the Article 8 elections on the Cover Sheet because we have elected to use the Collateral Annex for credit and collateral requirements. The Collateral Annex provides that it "supersedes and replaces in its entirety Sections 8.1(c), 8.2(c) and 8.3 of the Agreement[.]"

Please note that Sections I.A and I.B of Paragraph 10 of the Collateral Annex have been replaced in their entirety as specified on the Cover Sheet and the term 'Collateral Threshold' has been replaced by the term 'Collateral Threshold Amount'. In conjunction with this change, we also intended to replace the term 'Collateral Threshold' with the term 'Collateral Threshold Amount' in paragraph 3(b)(1) of the Collateral Annex and we will be making that change in the Master Agreement. Hence, the Collateral Requirement will be equal to Net Exposure less the Collateral Threshold Amount less previously transferred cash or letters of credit as specified in Paragraph 3(b) of the Collateral Annex.

FAQ-54Are there any application forms due besides the comments that are due on February 1 for the proposed contract?

It is expected that there will be application forms that RFP Bidders will use to submit their Proposals for the Standard Products RFP, to be posted by February 8, 2008. These application forms would be appended to the document setting out the process and rules for the RFP. This document is not included in the comment process for interested parties. The schedule that we was posted on January 30, 2008, and available here, provides deadlines for submission of the application forms. The deadline of noon on February 1, 2008 is strictly for comments on the draft Master Agreement.
